What’s Your Case Worth?

Great question! One of the most important things I do for my clients is provide a service, that at the end of the day, helps them recover losses. Monetary compensation will provide much needed financial relief to those who have been injured or wronged.

In order to determine how much your case is potentially worth, it’s important that you speak with a lawyer (like myself) who can ask the right questions to determine if your case has merit and what the outcome could ultimately be if we settle in or out of court. However, we also have a free instant case settlement tool you can click on below and see what your case could potentially be worth without speaking to anyone right now.

Frequently Asked Questions

Everyone wants to know exactly how much compensation they can get if they decide to file a personal injury lawsuit. However, each claim is different and will result in a different monetary amount being potentially awarded. Some factors that a judge will consider when deciding the amount of compensation due include:

  • Severity of the injuries
  • Long-term effects on the injured person, especially regarding the ability to work and earn an income
  • Proportion of blame the injured person shares for the accident
  • Payments already made for medical and other care by the injured person
  • Future potential expenses the injured person may incur related to the accident injuries
  • Impact on the injured person’s quality of life

Each of these factors, along with others as the case requires, will help a judge determine the exact monetary value of your personal injury or car accident claim.

Florida’s law allows for compensation for both economic and non-economic damages related to an injury and its subsequent required care to be included in a personal injury/car accident lawsuit, including:

  • Medical bills
  • Lost income (including benefits)
  • Rehabilitation expenses
  • Treatment costs for PTSD or other mental health issues,
  • Reduced quality of life
  • Damage to personal relationships
  • Permanent disfigurement
  • Permanent scarring
  • Mental trauma
  • Pain
  • Physical and emotional suffering
  • Subjective valuation of any disability
  • Damage to property
  • Punitive damages

There can be many other items included in the claim, depending on the nature of the case. For a full evaluation of your claim and help with valuation, contact Esposito Law at 877-ESPO-LAW.

The clients we represent may have injuries that range from broken bones to long-term, permanent disabilities. Just a few of the most common types of injuries we help file claims for include:

  • Broken bones
  • Whiplash
  • TBI
  • Paralysis
  • Internal bleeding
  • Burns
  • Road rash
  • Mental trauma

Well, that depends on the extent and severity of your injuries. For minor injuries that don’t require much care, your Florida Personal Injury Protection (PIP) insurance might cover enough of your expenses. However, PIP falls far short of covering all the potential expenses related to an accident. PIP only pays 80% of emergency care, 60% of lost wages, and a mere $5,000 in the event of death. If living on 60% of your income while trying to recover from serious injuries and paying thousands in unexpected medical bills sounds good to you, then give it a try with just PIP. If you want full, fair compensation for your injuries after an accident, call Esposito Law at 877-ESPO-LAW.

Just because an accident is partially your fault doesn’t mean that you can’t be compensated for your injuries. This is because Florida uses a pure comparative negligence system to evaluate the personal injury and accident claims. A judge will take into account your portion of the blame (usually calculated as a percentage) for the accident and use that percentage to help calculate the fair value of your claim. If the accident was entirely your fault, then it is very unlikely that you would receive any compensation.

Unfortunately, there are irresponsible people out there that operate motor vehicles without proper insurance. When you get in a car accident with someone who doesn’t have adequate insurance coverage, or even worse, has no insurance at all, don’t panic. We can still help you pursue compensation for damages from the responsible driver. Just be sure to get as much contact information from the other driver as possible and file a police report, even if the other driver runs. Then call Esposito Law at 877-ESPO-LAW for help getting the compensation you deserve.

For most personal injury and car accident cases in Florida, the statute of limitations to file a lawsuit is four years. However, this isn’t true for every case. If the lawsuit involves a death, for example, then the statute of limitations is much sooner. Medical malpractice or cases involving a government agency also have shorter deadlines. On the other hand, cases involving minors or defendants that cannot be located may be filed beyond the four-year mark. This is why it is so important to speak with a qualified personal injury attorney about your case as soon as possible after the accident. By involving an attorney early on, you can protect yourself and your loved ones from unnecessary financial burdens and stress.
